Man accused of killing four-year-old pleads ‘not guilty’

A man accused of killing a four-year-old boy appeared in the 347th Judicial District Court.

28-year-old Michal Duty, who is accused of killing his four-year-old stepson back on June 17, 2018, appeared before Judge Missy Medary.

The boy’s mother, 26-year-old Amanda Rose Pinon, did not appear in court. Pinon is also charged in connection with the boy’s death.

Two arrested, charged with capital murder in 4-year-old’s death

Duty was brought before the court for an arraignment and attorney status Tuesday afternoon. He entered a plea of not guilty. He was assigned Defense Attorney Mark DiCarlo.

Nueces County prosecutors said they have not made a decision on seeking the death penalty. When Judge Missy Medary asked why they have not, prosecutors said they are still waiting for results from the autopsy report.

Judge Medary set a re-status hearing 30 days from now.

DiCarlo asked Judge Medary if she could approve a request to lower Duty’s bond from one million dollars. Judge Medary denied that request.
