SAN PATRICIO COUNTY -

The Portland man accused of killing his father and setting their home on fire won't be going to trial anytime soon.

Portland Police say Andres Mushel, 24, killed his father, 63-year-old Chris Mushel on April 18th after they got into a fight. Andres then allegedly set fire to the house. He is charged with murder, aggravated assault and arson.

During a hearing this week, a San Patricio County judge ruled that Mushel was incompetent to stand trial after received a letter from Dr. Raul Capitan, the mental health expert who evaluated Mushel. The judge also ordered Mushel to be moved from the San Patricio County Jail and sent to a secure mental health facility for no more than 120 days.  Medical experts there will evaluate Mushel over the next few months and determine whether he is mentally competent to stand trial.
