CORPUS CHRISTI - Delia Morales is in court today to sue Berry Contracting and Trinity Highway Products for the death of her husband, 35-year-old Jesus Morales Jr.
On September 2, 2011, Jesus Morales was killed instantly when his pickup crashed into the back of a large commercial truck parked along SPID. The construction company truck was in the process of picking up roadwork signs after a project had just been completed.
Morales claims the company is negligent for failing to provide advanced warning to motorists about the blocked lane.
In opening remarks, attorneys representing Morales said the company, "sacrificed the publics safety" by not placing warning signs in front of the vehicle. He says the company should have had a warning vehicle placed before the other vehicle to warn motorists. The lawyer expressed the family is suing the construction company for loss of income, due to the husband's death, and medical bills.
The lawyers for company said while, "no doubt there was a loss of life" they "don't believe there is any evidence to support negligence."
This afternoon the court will hear testimony from accident reconstructionists, TxDOT officials and Delia Morales.
