CORPUS CHRISTI - A murderer lost his fight in District Court to delay his execution date.
Attorneys for Jose Villegas said he was unstable and not mentally competent in 2001 to understand what he was doing when he stabbed to death his girlfriend, her 3-year-old daughter and her mother.
Judge David Stith denied the effort to spare Villegas from lethal injection on April 16th. Under Texas law, anyone deemed mentally incompetent cannot be subject to capital punishment.
Villegas still has another week for attorneys to pursue other appeal options.
