Teen Overdose Case Going to Trial Next Month

CORPUS CHRISTI -- A trial is set for next month in the case of a local family suing CVS Pharmacy and a local doctor.

The mother of 18-year-old Brandon Garcia says Dr. Jeffrey Johnson wrote prescriptions for Xanax and Hydrocodone for her son without checking his medical history.

The next day Brandon and his friend 15-year-old Kady Lacy overdosed on the pills and died.. The attorney for the doctor tried pushing back the trial date so that discovery could be completed and mediation could be attempted, but Judge Nanette Hasette told both attorneys she would not delay the trial.

The case was filed in February 2011, it's set for a jury trial February 25th.
