CORPUS CHRISTI - There may be a little more trouble on the horizon for Rodrigo "Roy" Hinojosa, that former Taft High School band director caught having sex with a student last year.
The Nueces County District Attorney's office told KRIS-6 today that Hinojosa, who just got out of San Patricio County jail for the crime, may be headed right back.
About this time last year, 50-year-old Hinojosa was caught at the Best Western motel in Sinton with his 17-year-old student.
According to police documents, the girl told officers she met up with Hinojosa at the motel and had sex with him there.
Prosecutors there charged him, an educator, with having an improper relationship with a student.
That's a felony in Texas and he later pleaded guilty to ten counts of it.
He got ninety days in jail and 10 years probation from San Patricio County.
Now, Hinojosa is back in court, this time in Nueces County where he faces another count of having sex with the same girl.
According to court documents, Hinojosa and the girl met up at the Red Roof Inn on South Padre Island Drive back in 2012.
He pleaded guilty, again, to having an improper relationship with a student and again got ten years probation.
But Nueces County is asking 94th District Judge Bobby Galvan, for more.
In addition to the 10-year-plea deal on the charge, Assistant Nueces County Prosecutor Brittany Jensen asked Galvan to send Hinojosa to jail for six months.
Galvan is considering the request.
Hinojosa told the court that he and the girl had made plans to be married when she is legally able to do so.
But the terms of the plea deal are clear: he goes to prison for a decade if he makes contact, of any kind, with the girl.
It's important to note that even though Hinojosa lost his job as a teacher he still has a valid teaching certificate.
The certificate is flagged by the Texas Education Agency as subject to official sanctions but the state was not able to confirm today whether they are investigating Hinojosa for the Nueces County charge.
