South Texas Jury Considers Penalty In Baby Death

BROWNSVILLE - A South Texas man faces up to 99 years in prison for the 2008 starving death of his 4-month-old nephew.

The penalty phase continues Tuesday in Brownsville for 32-year-old Abraham Proenza of San Benito.

Jurors on Friday convicted Proenza of intentionally causing serious bodily injury to a child. Aiden Valdez when healthy weighed 11 pounds but was about 8 pounds when he died in Proenza's care.

Proenza testified he didn't seek help for Aiden because he was not the parent. Investigators say Proenza and his wife took the child and planned to adopt him after his mother - Proenza's sister-in-law - threatened to leave her newborn son at a hospital.

Proenza was left with the boy after his wife took an out-of-state job when the baby was 3 months old.
