KINGSVILLE - A man convicted of sexually abusing two young girls may walk out of court today serving just probation. Kingsville ISD school board member Rudy Macareno admitted in open court today that he sexually abused the girls.
It's the admission prosecutors and the victim's family wanted. Even the prosecutor in this case suggested a lenient sentence because Macareno admitted his guilt.
Jurors have the option of sentencing Macareno up to life in prison on charges felony indecency with a child and aggravated sexual assault of a child. Jurors also can fine Macareno up to $10,000 for each charge
But his defense attorney argued that probation is not a walk in the park and that his client cannot afford the fine because he needs to care for his quadriplegic son.
He also said Macareno is marked for life with these convictions.
We spoke to one victim's mom while she waited for the jury to come back with a sentence. She's not necessarily satisfied with probation, but she tells me proving her daughter is not a liar is what mattered most.
The jury was unable to reach a decision on the sentence this afternoon. Court will resume tomorrow morning.
Members of the school board asked Macareno to resign last year as he was under indictment, but he refused. Under state law, the board was unable to force Macareno to resign his post.
It will be up to a court to decide whether Macareno will be removed from his elected position. If that happens, the school board will then move to choose a method for filling the vacant seat.
