CORPUS CHRISTI -- A Bishop man who's been charged with 2 counts of capital murder will face the death penalty during his trial.

Noe Salinas is accused of shooting 3 men at a Bishop home in August. 2 of the victims, Mario Briones and Juan Casso died in the shooting. Investigators say it stemmed from an argument between Salinas and Casso. Casso was reportedly upset because Salinas had spanked Casso's child.

Salinas' family was in the courtroom Friday when the court read the formal charges to Salinas and the district attorney made it clear that the death penalty will be used in this case. Hector Gonzales, Salinas' attorney says that was something the defendants family wasn't expecting.

"It's harsh, I mean, you have a son that you believe and love and the last thing you want is hearing the state of Texas is seeking the death penalty," Gonzales said.

Gonzales says, the family claims that Salinas was only defending himself and he should not be facing such severe charges.

"With time I think they'll understand what it all means but at this time they're in shock," Gonzales said.

Salinas pled not guilty before Judge Jose Longoria after his charges were read to him by the court.

"The indictment reads that my client was involved in a multiple slaying of two individuals and we maintain our defenses to that and were hoping that all the facts will come out in the courtroom," Gonzales said.

Police say the shooting left the 2 men dead and a third injured but Gonzales says he is prepared to go to trial for Salinas and prove self defense.

"We're confident that we will get a fair trial in, and hopefully my client will be vindicated of this matter," Gonzales said.

No trial date has been set for this case.
