Robstown Police: Man Did Hokey Pokey During Sobriety Test

ROBSTOWN -- This week, a Robstown man pleaded guilty to his 5th DWI and got 32 years in prison for it.

The courts released dash camera video today of Benito Alvarado taking a field sobriety test last May.

In the video, Officers say Alvarado was so drunk, he did the Hokey Pokey during the test.

District Attorney Mark Skurka says his blood alcohol content was nearly
four times the legal limit.

He said, "Every time Benito Alvarado got behind the wheel of a car it's just like putting a bullet in the gun and aiming it down the highway. Who's the first person he's going to strike?"

Fortunately, Alvarado never hurt anyone while driving drunk.

But, Skurka says he wanted to make sure he wouldn't do it in the future either.

He recommended the judge sentence him to 40 years in prison.

The defense attorney asked for the lightest sentence of 25 years.

The judge chose to sentence Alvarado to 32 years.

Skurka said, "I mean those people are hazardous. I don't want them on the street, I don't think you do either."

According to court documents, Alvardo did jail time, probation and went through DWI education programs.

So, he got several "chances" but continued to drive drunk.

Skurka says rehabilitation works for some, but for Alvarado it didn't.

Skurka said, "My intent on Mr. Alvarado and anybody that has something like that is to keep them off the streets as long as possible because they've shown they can not reform themselves."

Skurka says Alvarado started drinking at 10:00 in the morning when police pulled him over in May...and say he didn't stop until cops arrested him at around 4:30 in the afternoon.

Officers say they even found a cold opened can of beer in his truck!
