CORPUS CHRISTI -- The Nueces County prosecutor caught in the middle of scandal involving allegations he snooped through a judge's cell phone is speaking publicly for the first time since the incident.
Doug Mann, an assistant district attorney, said while he did read a text message on Judge Angelica E. Hernandez's phone, it was an accident.
"I heard a cell phone chime just exactly as mine would for a message," said Mann. "I reached down, touched the cell phone and saw a screen that contained a banner for a message that had come into the phone."
Mann said he and Defense Attorney Eric Perkins were in the court coordinator's office on Tuesday waiting for Hernandez to arrive when the incident happened. He said he was not sharing the message with Perkins, rather he was telling him that he accidentally picked up the Hernandez's phone when the court coordinator walked in the office.
Mann and Perkins were ordered to attend several hours of legal ethics classes before they can appear before the 105th District Court again.
