CORPUS CHRISTI - A family has reached a settlement with Corpus Christi Realty Management in the death of a young boy run over in the Chuck E Cheese parking lot in 2010.
The company owns the parking lot where the pizza place is located. According to a spokesperson for the Hilliard Law Firm, the case settled out of court this week. The settlement is confidential.
3-year-old Eli Rodriguez died when he ran out in front of a pickup truck leaving a nearby business. Security video from the restaurant shows the boy get out of the car on his own and run across the parking lot by himself.
The driver of the pickup told police she never saw the boy. She stopped immediately after hitting him. The boy's mother, Yvonne Rosas, ran up immediately and cradled her mortally wounded son in her arms as she screamed for help.
The driver was never charged with a crime because investigators determined it was an accident.
The boy's mother sued the restaurant, property managers, and the owners of the shopping center claiming they failed to provide a safe environment.
She settled with Chuck E Cheese and CC Quality Construction, the owner of the shopping center, back in November.
The mother was asking for $50 million, plus another $30 million for each of her 2 other children, but the settlement amount remains confidential.
