CORPUS CHRISTI - A father convicted of injury to a child for throwing his 5-month-old out of a car is now headed to prison for five years. Police say he threw the child car seat out of the vehicle, with the child still in it, during an argument with his common law wife last year.

Henry Molina's car was not moving at the time and the now one-year-old child did not suffer serious injuries in the incident.

During the trial, Molina's wife testified that she had never seen him being violent towards his two children before the incident. A representative from Child Protective Services gave the same testimony.

Molina admitted he was high on marijuana and cocaine when he threw the child. He argued that his behavior was out of character.

Officials are now considering what to do about the family situation with Molina headed to prison. We're told his common-law wife is bipolar and unable to find work. She currently relies on Molina's paychecks to care for her two young children.

A hearing is set for March 7th to decide the childrens' fate.
