CORPUS CHRISTI - The defense for Micah Spanutius filed for a mistrial Tuesday afternoon right after lunch.
Prosecution says they found out one of the jury members was the father in law of an employee in the District Attorney's office.
Prosecution and defense agreed that they believe this was an honest mistake, and the juror just misunderstood a question during selection.
The new trial is set to start February 22 with another jury selection.
