CORPUS CHRISTI - We will soon find out whether the deputy constable charged with retaliation this week will be terminated.
54-year old Ben Zapata was arrested this week by Robstown police. He is charged with retaliation after his girlfriend said he punched her in the mouth, dragged her by her hair, and threatened to kill her.
According to an incident report from 2011 this isn't the first time she has told police he hit her. In the report she told police Zapata hit her on the left side of her face causing pain when they were driving home. According to his police record no charges were filed in connection with that incident.
We spoke to his boss, Constable Frank Flores, who says Zapata knows this type of behavior is unacceptable.
"I have a zero tolerance when it comes to misconduct. Whether an employee or a Deputy, I'm not going to tolerate any of that behavior," said Flores.
Flores says Tuesday Zapata turned in his gun and badge to him.
"I've asked for him to bring in his weapon because of course, he's out on bond. And he's brought in his complete gear," said Flores.
Flores says Zapata is currently on vacation, a vacation he went on before his arrest. And the decision the Constable has to make about Zapata's career is one he isn't taking lightly.
"I don't want to rush into judgement and make a decision that I'm gonna regret later," said Flores.
Constable Frank Flores is expected to decide if Zapata will be fired tomorrow afternoon.
