ALICE - A jury is now deliberating in the murder trial of Vidal Ben Garcia. He's accused of shooting his common-law wife inside a bathroom at the Texas Health and Human Services Department building in January 2012.
Garcia's defense attorney argues Kimberly Gonzales committed suicide and he just found her body in a bathroom stall. The jury will have to weigh that argument against testimony from state witnesses who said the way Gonzales died is not indicative of a suicide. An expert also said gunshot residue was found on Garcia's clothing, but not on his hands.
The estranged husband was arrested a short time after the shooting, but police did not test for gunshot residue until four hours later.
