KINGSVILLE - A Kleberg County jury continues deliberating the sentence for Rudy Macareno, a Kingsville School Board member convicted of indecency with a child and sexual assault of a child.
The panel is considering a wide range of punishment options, from probation to life in prison.
During sentencing, Macareno admitted in open court that he sexually abused a girl. It's the admission prosecutors and the victim's family wanted. The victim's mother told us she was glad he admitted as much, so no one would continue thinking her daughter was lying.
The prosecutor stated he would agree with a sentence of probation as long as it was a 10 year term. Macareno's defense attorney argued that probation is not a walk in the park and his client cannot afford a $10,000 fine because he needs to care for his quadriplegic son.
Members of the school board asked Macareno to resign last year as he was under indictment, but he refused. Under state law, the board was unable to force Macareno to resign his post.
It will be up to a court to decide whether Macareno will be removed from his elected position. If that happens, the school board will then move to choose a method for filling the vacant seat.
