CORPUS CHRISTI -- Convicted capital murderer John Henry Ramirez appeared in a Nueces County courtroom today for a pre-trial hearing.
Ramirez was sentenced to death in 2008 for the fatal stabbing of Pablo Castro during a robbery. He still faces trial for two other aggravated robbery charges and evading arrest.
However, Ramirez's lawyers are fighting that.
They say the case should be dismissed because he was already punished for those crimes during his capital murder sentencing.
The judge did grant the defense a continuance for the trial.
Assistant District Attorney Mark Skurka says this will hold things up, but he expects the case will eventually move forward.
He said, "I believe their arguments are baseless and they wanted to file some appeal writ type thing, but I'm pretty satisfied that the law will be on our side."
Ramirez's lawyer, Larry Warner said, "If you just stop and think, stop being a lawyer for a minute, wait does this sound fair? Is it fair to punish the guy twice for exactly the same thing, it doesn't seem fair."

I think you do the crime you pay the crime still.So there is three diffent crimes so he should be punish for those also no matter what happens.
