CORPUS CHRISTI - The man who was being investigated for impersonating a police officer, will not be charged with impersonation of a public servant.
It happened on November 1, 2012.
Police said 60 year old Mark Byrne was shining a light at cars on SPID.
One driver slammed on the brakes causing Byrne to hit his brakes and an off-duty officer had to swerve to avoid hitting Byrne's car.
Byrne began following the officer, who called for backup.
According to police, the District Attorney's office decided not to prosecute Byrne for impersonation.
However, he's still facing a reckless driving charge.
