Court Rejects Texas Landowners' Pipeline Argument

HOUSTON (AP) - A Texas court has rejected an appeal filed by landowners who argued a Canadian company did not have the right to condemn their land to build a pipeline designed to eventually transport tar sands oil from Canada to Texas refineries.

The 9th Court of Appeals in Beaumont handed down its decision Thursday, rejecting arguments presented by Rhinoceros Ventures Group, Inc. and Batson Corridor, LP.

The landowners' attorney Robert Wade says they plan to appeal to the Texas Supreme Court.

The court battle is one of many in Texas as landowners fight TransCanada's construction of the oil pipeline across the state. The larger, cross-border project still doesn't have the necessary approval to proceed from the U.S. State Department. The portion of the pipeline from Oklahoma to Texas is under construction.
