CORPUS CHRISTI - The City of Corpus Christi filed a lawsuit, Thursday, against David McCarthy, President, CEO and owner of New York-based Community Showcase Banners.

According to City Attorney Carlos Valdez, David McCarthy duped former Mayor Joe Adame into signing an agreement at a Mayoral conference in June.

Valdez claims, at the conference, McCarthy asked the Mayor to sign a document to accept a community showcase award. Valdez said the so-called award was actually a banner sales promotion.

Valdez said former Mayor Adame didn't know the deal he signed would make the city responsible for the installation, maintenance and replacement of banners by community Showcase Banners for a period of three years. Additionally, he says it gave the company the right to use the City of Corpus Christi as a selling point on the banners.

"He's telling people, 'this is a city program. The city is participating in this. It's endorsed and authorized by the city,'" Valdez said, "And that is not the case."

Under the Corpus Christi form of Government, the Mayor doesn't have the authority to enter into such contracts. The City Attorney is asking for a court to issue a restraining order that order would stop McCarthy from selling these banners to businesses in the area. It would also require him to turn over the money he has obtained so far to the court.

David McCarthy said he is "taken aback" by the lawsuit. He said the contract notes that the city would not be responsible for the cost of installing, maintaining or replacing the banners.

Former Mayor Joe Adame has not immediately returned a phone call for comment.
