CORPUS CHRISTI - David Garcia's brother, Hector Garcia says the family didn't know about David's death until the medical examiner notified them on Tuesday.
He says even though his brother had a criminal past, he thinks shooting him in the head was too extreme.
"He could've got shot in the leg or something like that but he got shot in the head, come on you know, you can't take a person's life shooting them in the head," Hector said.
He described the kind of man David was during his short life. "David was a nice man.. and outgoing," he added.
Hector says it was no secret that his big brother had hit a rough patch in his life. In fact, he had just finished doing 13 years in prison, on theft charges. However, Hector says his poor life choices were no reason for him to lose his life.
"It's just hard you know what I mean, you know he messed up stealing beer and all that but he didn't deserve to lose his life over that," Hector said.
He says he was shocked to hear that Rodney Duve, the shop owner charged with David's murder, had a bond set at $35,000.
"That's at $3,500 to get out, that's not fair, he took my brother's life, his life needs to be taken too, stay in prison," he said.
Meanwhile, the Garcia's are working to put together funeral arrangements for their loved one's unexpected death.
"We're having trouble getting money together, to do the funeral arrangements right now, the life insurance isn't covering nothing so we're going to have to pay out of pocket," Hector explained.
He says they hope to hold a benefit this Saturday in memory of David, they don't know where it will be held yet.
