CORPUS CHRISTI - A Border Patrol agent is accused of sexual assaulting a undocumented immigrant he was guarding at Christus Spohn Memorial late last month.
According to court documents, the accuser was admitted to the hospital on April 18th to be treated for an injury to her arm.
The woman told a nurse that Agent Phillip Westerman used his fingers to violate her as he also masturbated.
She told police she awoke to find the agent sexually assaulting her. The accuser used a paper towel to clean up the semen which she saved under her pillow for investigators. She claims she found the evidence in the bathroom when she went to take a shower after the alleged assault.
When interviewed, Westerman denied the accusations. He told investigators he sat in a chair close to the woman's bed while standing guard. According to the affidavit, Westerman claims the accuser aroused him by rubbing her foot on him, so he went to the bathroom to masturbate.
Westerman is being held in the Hidalgo County Jail on felony sexual assault charges. The Border Patrol has placed him on administrative leave.
