ALICE -- A man whose house was flooded with raw sewage water and feces has filed a complaint in court against the city and one of its employees alleging that the city's insurance company never paid for damages to the house.
Ramon De Leon, who would not speak with us citing his attorney's advice, filed the complaint Sept. 27. It alleges that the city and one of its employees, who is not named, is responsible for the damage that caused most of his home to be gutted.
According to the complaint, "The estimate completely failed to include other damages such as flooring, for which there does not seem to be any provision."
Frank Hinojosa, the restoration specialist whose company removed the sewage, said it cost just over $20,000 to remove the water. He estimates it will cost another $41,000 for his company to restore parts of the home damaged by the flood. But the city's insurance company, Texas Municipal League, has not yet issued a check for the restoration, he said.
Rey De Los Santos, the Alice city manager, would not comment on the situation because of a possible pending lawsuit, but said the city is in an interesting position. "The city has a certain level of frustration as well because we cannot force T.M.L. to offer a certain amount nor can we force the [De Leon] family and their attorney to accept a certain amount."
The city council was scheduled to meet behind closed doors to discuss the issue Monday night. A court date has not yet been set.
